    "Description": "Resultando que, convocada licitación para la contratación del servicio de mantenimiento de los equipos de protección contra incendios en el Patronato Deportivo Municipal por procedimiento abierto simplificado y varios criterios de adjudicación, se publicó anuncio en el perfil del contratante con fecha 14 de septiembre de 2026, y se presentaron tres ofertas por parte de las empresas Desel Sistemas contra Incendios, SL, Detex Seguridad y Sistemas contra Incendios, SL, y Proinlec Norte, SL.
\n
\nResultando que la mesa de contratación procedió con fecha 30 de septiembre de 2026 al descifrado, descarga y apertura del fichero único, relativo a la documentación administrativa acreditativa de las condiciones legalmente previstas para contratar y a los criterios de adjudicación cuya valoración responde a fórmulas aritméticas, y se formuló propuesta de exclusión de la oferta presentada por la empresa Proinlec Norte, SL, por exceder del tipo de licitación anual de 4778,57 €, IVA excluido, y se valoraron el resto de las presentadas 
\nResultando que se requirió a Detex Seguridad y Sistemas contra Incendios, SL, para que aportara la documentación relacionada en el artículo 150.2 de la Ley 9/2017, de 8 de noviembre de Contratos del Sector Público, la cual se presentó por la empresa en plazo, declarando su disposición a prestar el servicio a pesar de incumplir el requisito de contar con delegación en Asturias establecido en los pliegos de cláusulas administrativas particulares.

\nConsiderando que el artículo 150.2 de la Ley 9/2017 señala que cuando el licitador propuesto no cumplimente adecuadamente el requerimiento se entenderá retirada su oferta y se recabará la misma documentación del licitador siguiente conforme al orden de clasificación.
\n
\nVisto el informe jurídico de 23 de octubre de 2026, donde se concluye que no procede imponer a la empresa la penalidad del 3 % del presupuesto base de licitación, IVA excluido, al haberse producido una cumplimentación material del requerimiento, aunque insuficiente para acreditar el cumplimiento del requisito obligatorio del apartado 6 del pliego de prescripciones técnicas.
\n
\nResultando que, en consecuencia, se efectuó el requerimiento del artículo 150.2 a Desel Sistemas contra incendios, SL, el cual fue cumplimentado en tiempo y forma por la empresa.
\n
\nResultando que según informe de la intervención delegada del Patronato Deportivo Municipal de fecha 10 de septiembre de 2026, existe consignación para hacer frente a los gastos derivados de la presente contratación.
